Terms of Service

1. Acceptance of terms

By accessing or using EvalTour (the "Service"), you agree to these Terms. If you do not agree, do not use the Service. EvalTour is provided by EvalTour, a term contract holder with the Florida Department of Management Services (Contract No. 80101500-25-STC).

2. The free audit

The 15-minute organizational readiness audit is free and requires no account. Your assessment answers are stored locally in your browser. We provide the score, gaps, roadmap, and balance sheet as informational guidance — not as professional, legal, or financial advice. You are responsible for decisions made based on the results.

3. Accounts

Creating an account lets you save and revisit your results, edit your plan, and download reports. You agree to provide accurate information, keep your credentials secure, and not share your account. You are responsible for activity under your account.

4. Consulting services

Booking requests and consulting services (workshops, planning sessions, pilot sprints, etc.) are separate engagements. Their scope, pricing, and deliverables are confirmed in a separate statement of work or proposal before any paid engagement begins. Submitting a booking request does not create a binding contract until both parties confirm.

5. Acceptable use

You agree not to misuse the Service — including attempting to access other users' data, reverse-engineer the platform, submit harmful or automated requests, or use the Service for unlawful purposes. Captured lead data is admin-restricted; attempts to circumvent access controls are prohibited.

6. Intellectual property

EvalTour, its methodology, the staircase mark, reports, and software are owned by EvalTour. Reports you export are licensed for your internal business use. You may not resell, redistribute, or publicly republish the Service or its content without permission.

7. No warranty

The Service is provided "as is" and "as available." Readiness scores, projections, and recommendations are estimates based on the answers you provide and industry benchmarks; actual outcomes depend on your organization's execution. We make no warranties that results will be accurate, complete, or achieved. To the extent permitted by law, we disclaim all implied warranties.

8. Limitation of liability

To the maximum extent permitted by law, EvalTour shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits or data, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the prior twelve months, or one hundred dollars, whichever is greater.

9. Indemnification

You agree to indemnify and hold EvalTour harmless from claims arising from your misuse of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or for any business reason, with notice where appropriate.

11. Changes to terms

We may update these Terms. Material changes will be communicated to registered users. Continued use after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
